Ten overtime hours at $25 an hour add $375 to your paycheck in Ontario. Under the Employment Standards Act, most employees earn 1.5 times their regular rate for every hour worked past 44 in a week, so each $25 hour becomes $37.50 once you cross the threshold. This free Ontario overtime pay calculator applies that exact rule: enter your hourly rate, your regular hours, and your overtime hours to see your regular pay, your overtime pay, and your weekly total. If you also want the after-tax picture, run the result through our Ontario paycheck calculator to see take-home pay after federal and provincial deductions.

Ontario Overtime Rules for 2026
Ontario’s overtime rule comes from the Employment Standards Act (ESA). Overtime pay is 1.5 times the employee’s regular rate of pay, a premium often called time and a half. For example, an employee with a regular rate of $25.00 an hour has an overtime rate of $37.50 an hour.
The rule covers most employees, whether they work full time, part time, are students, or are temporary help agency assignment employees. The Government of Ontario publishes the full rule in its guide to overtime pay under the Employment Standards Act.
Overtime is calculated on a weekly basis. Unless your contract of employment or collective agreement says otherwise, there is no daily overtime in Ontario: working one long day does not trigger the premium by itself. What matters is the total for the work week.
The 44-Hour Threshold Explained
In Ontario, hours worked over 44 in a work week are overtime hours. The first 44 hours are paid at your regular rate, and every hour after that is paid at 1.5 times your regular rate.
| Total hours worked in the week | Overtime hours | Hours at regular rate |
|---|---|---|
| 40 | 0 | 40 |
| 44 | 0 | 44 |
| 45 | 1 | 44 |
| 50 | 6 | 44 |
| 55 | 11 | 44 |
| 60 | 16 | 44 |
An employee and an employer can also agree electronically or in writing to average hours over a longer period instead of using the weekly threshold. Averaging lets variable weeks balance out, but it cannot be used to take away the right to overtime pay.
Instead of overtime pay, an employee and an employer can agree electronically or in writing that the employee will receive paid time off: 1.5 hours of paid time off for each overtime hour worked. The time off must generally be taken within three months of the week in which the overtime was earned.
Who Is Exempt From Overtime Pay in Ontario
Not everyone is covered by the overtime rule:
- Managers and supervisors do not qualify for overtime if the work they do is managerial or supervisory in nature.
- Some industries and occupations are exempt from the overtime provisions altogether, while others have an overtime threshold above 44 hours in a work week.
- Your regular wage cannot be lowered to dodge the premium. An employer cannot cut your hourly rate to avoid paying time and a half after 44 hours.
- You cannot sign away the right. An agreement to give up overtime pay is not allowed and would be treated as void, although banking overtime as paid time off is permitted.
If your role is unusual, check the ESA special rules or ask the Ministry of Labour, Immigration, Training and Skills Development whether an exemption applies to you.
Overtime Pay Examples
At a $25.00 regular rate, the overtime rate is $37.50 an hour. Here is what different amounts of overtime add to a week:
| Overtime hours | Overtime rate | Extra pay earned |
|---|---|---|
| 2 | $37.50/hr | $75.00 |
| 5 | $37.50/hr | $187.50 |
| 8 | $37.50/hr | $300.00 |
| 10 | $37.50/hr | $375.00 |
Full week example. You earn $25.00 an hour and work 40 regular hours plus 5 overtime hours. Regular pay is 40 x $25.00 = $1,000.00. Overtime pay is 5 x $37.50 = $187.50. Your total for the week is $1,187.50.
Over the 44-hour threshold. You earn $25.00 an hour and work 53 hours in one week. Nine hours are overtime (53 minus 44). Regular pay is 44 x $25.00 = $1,100.00. Overtime pay is 9 x $37.50 = $337.50. Your total is $1,437.50.
Salaried example. Your salary is $950.00 a week and you work 50 hours. Your regular hourly rate is $950.00 divided by 44 = $21.59. Your overtime rate is $21.59 x 1.5 = $32.39. Six overtime hours (50 minus 44) give $194.34 in overtime pay. Regular salary $950.00 plus overtime $194.34 = $1,144.34 total.
How Overtime Affects Your Take-Home Pay
There is no separate overtime tax rate in Canada. Overtime pay is added to your regular income and taxed at your marginal rate, and CPP and EI deductions apply to it just like regular wages. Because overtime raises your gross pay for the period, it can push part of that week’s income into a higher tax bracket and increase your total deductions.
To see the after-tax effect, run your overtime-inclusive gross through our payroll deductions calculator, which estimates federal tax, Ontario tax, CPP, and EI on your pay.
Frequently Asked Questions
How is overtime pay calculated in Ontario?
Multiply your regular hourly rate by 1.5 to get your overtime rate, then multiply that rate by your overtime hours (hours worked over 44 in the week). For example, at $25.00 an hour with 5 overtime hours: $37.50 x 5 = $187.50 in overtime pay.
Is overtime after 40 or 44 hours in Ontario?
In Ontario it is 44 hours. Many people assume 40 because that is the standard in some other provinces and in the United States, but under Ontario’s Employment Standards Act the 1.5x premium starts after 44 hours in a work week.
Who is exempt from overtime pay in Ontario?
Managers and supervisors whose work is genuinely managerial or supervisory are the main exemption. Some industries and occupations are also exempt or have a higher overtime threshold, so check the ESA rules for your specific job.
Do I earn overtime for working more than 8 hours in a day?
Not by default. Ontario calculates overtime weekly, not daily. A 12-hour day only creates overtime if your total for the week passes 44 hours, unless your contract or collective agreement provides daily overtime.
Is overtime pay taxed differently in Ontario?
No. Overtime pay is employment income, taxed at your marginal federal and Ontario rates exactly like regular wages. CPP and EI also apply.
Can I take time off instead of overtime pay?
Yes, if you and your employer agree electronically or in writing. You bank 1.5 hours of paid time off for every overtime hour worked, and the time off must generally be taken within three months of the week in which the overtime was earned.
